These terms apply to all work by BrightSide Media & Design (Charne Smit, East London). By accepting a quote, paying a deposit or using our services, you agree to them. The terms on your written quote or invoice form part of this agreement.

1. Quotes

Quotes are valid for 14 days. Work only starts once the quote is accepted in writing and the deposit is paid. Anything not listed on the quote is extra and will be quoted separately.

2. Deposits and payment

• A 50% deposit is required before work starts. The deposit is non-refundable, as it secures your booking and covers time already spent.
• The balance must be paid before a website goes live or final files are handed over.
• Invoices are payable within 7 days. Late payment may pause work, and live websites or monthly services may be suspended until the account is settled.
• Payment is by EFT, using your invoice number as the reference.

3. Revisions

Each project includes two rounds of revisions. Further changes, or changes to the agreed scope, are charged at our standard rates and quoted first.

4. Your responsibilities

• You supply your content (text, photos, logos, prices) on time and confirm you have the right to use it.
• Delays in supplying content or feedback may move the delivery date. Projects inactive for 30 days because of missing content may be closed, and the deposit is kept.
• You are responsible for checking and approving your work before it goes live.

5. Third-party costs

Domain names, hosting, paid advertising spend, stock images, plugins and other third-party services are charged at cost and paid by you. Advertising spend goes directly to the platform (for example Meta or Google) and is separate from our setup fee. We cannot control third-party price changes, outages or policies.

6. Monthly plans

Monthly social media and website care plans are billed in advance. Growth and Pro plans have a 3-month minimum term. After that, any plan can be cancelled with one calendar month's written notice. Unused posts or hours do not roll over.

7. Results

We work hard to grow your business online, but we cannot guarantee specific results such as rankings, followers, leads or sales, as these depend on many factors outside our control.

8. Ownership

Ownership of the final designs and website transfers to you only once your account is paid in full. Until then, all work remains the property of BrightSide Media & Design. Draft concepts not chosen remain ours.

9. Portfolio

We may show completed work in our portfolio and on social media, unless you ask us in writing not to.

10. Liability

Our total liability for any claim is limited to the amount you paid for the specific service concerned. We are not liable for indirect losses, such as lost income, or for problems caused by third-party services, your own changes, or content you supplied.

11. Cancellation

If you cancel a project after it starts, the deposit is kept and any work completed beyond the deposit value is charged.

12. General
